The paper dives at the source of disclosure regulation failure using artificial intelligence (especially NLP and ML tools). It does so by computing semantic ambiguities in the position papers submitted by the stakeholders to the European Commission’s consultation over the Digital Services Act (DSA) and Digital Markets Act (DMA). By analyzing the significant differences in use and understanding of concepts related to transparency and disclosure duties, the paper provides fresh and unexpected insight as per why these duties, once the rule-making process will be ended and the positions will translate into law, may become ineffective.
